The Government has confirmed that parental bereavement leave will come into law on 6 April 2020.

From this date, parents who suffer a stillbirth on or after the 24th week of pregnancy, or the loss of a child under the age of 18, will be entitled to two weeks’ statutory parental bereavement leave. This will be a day one right.

To be eligible, the employee will need to be one of the following:

  • birth parent

  • adoptive parent

  • those fostering to adopt

  • legal guardian

  • foster parent (although emergency foster care may not be covered).

Eligible employees will be able to take the leave as either a single block of two weeks, or as two separate blocks of one week, each taken at different times during the 56 weeks after their child’s death.

Employees who have at least 26 weeks’ continuous service and earn over the lower earnings limit (currently £118 per week) will be entitled to statutory parental bereavement leave pay, in line with other family leave rates. The current statutory rate for family leave is £146.48 and is set to increase on 5 April 2020 to £151.20.
