On 31 January 2014, the Collective Redundancies and Transfer of Undertakings (Protection of Employment) (TUPE) (Amendment) Regulations 2014 came into force (to be followed later in the year by changes to the corresponding legislation for Northern Ireland).

There is no change to the rules relating to service provision changes under the 2014 Regulations. However, they do clarify that for TUPE to apply to a service provision change, the activities carried on after the change must be “fundamentally or essentially the same” as those carried on before it.
