Duty on the Employer

The Confined Spaces Regulations 1997 begin (regulation 3) by placing a duty on every employer to ensure compliance with the provisions of the Regulations in respect of any work carried out by their employees.

Regulation 3 then requires the employer to ensure compliance, so far as is reasonably practicable, with the provisions in respect of any work carried out by persons other than its employees in so far as the provisions relate to matters within its control, ie contractors.
