The Road Transport (Working Time) (Amendment) Regulations 2012 amend the Road Transport (Working Time) Regulations 2005 so that they apply to self-employed drivers.
The ECJ has confirmed that, on termination, workers who have been unable to take holiday due to sickness would be entitled to an allowance in lieu of the four weeks provided by the Working Time Directive.
The Working Time Regulations 1998 apply, with exemptions, to all workers, ie not only employees but also individuals who contract to perform work personally for an employer. Who do the Working Time Regulations Apply To?
