An increasing number of employees are choosing to have elective surgery, that is, surgery that is subject to choice (ie election) as opposed to urgent or emergency surgery. Examples include laser eye surgery, dental implants, IVF or varieties of cosmetic surgery.
An employee who is not able to work because of illness, subject to the notification requirements, will be entitled to statutory sick pay, regardless of the reason for the incapacity. Contractual sick pay may also apply in line with the terms of the employment contract and can lead to some potential problems for the employer, as outlined below.
