Examples of cases where employment tribunals have found that employers had proper grounds for dismissal on account of an employee’s criminal conduct outside of work include the following.
A security officer in a shopping centre who liaised with police as part of his duties was dismissed after an assault on a police officer. The tribunal agreed that such conduct was inconsistent with his employment. Payne v English Property Corporation Ltd (COIT 900/216)
A supervisor who assaulted a subordinate at a company function was fairly dismissed. The employer’s decision was influenced by the supervisor’s seniority and status. Riley’s Potato Crisps Ltd v Warden (EAT/761/81)
