Receiving a Summons

When a road traffic offence is not dealt with under the Fixed Penalty system then the person who is alleged to have committed that offence will be summoned to the magistrates’ court. There are a number of enforcement bodies who may lay information before the court about an alleged offence. These include:

  • Police

  • DVSA

  • Trading Standards

  • Health and Safety Executive

  • DVLA.

Information is laid before the court in the district where the offence was committed. Once the court has the information, a summons will be issued and sent to the person who allegedly committed the offence. That person then becomes a defendant.
