From a statutory perspective there are three separate functions in the management of a care service: registered provider, registered person or nominated individual, and registered manager. The registered provider can be the registered manager. This is often the situation when an owner has only one business, which they manage themselves. They must, however, fulfil the tests of registration for both roles.
A registered provider might also appoint a registered manager as their “nominated individual” to be accountable as the registered person for the service in that location.
Registration of a person or manager is separate process from the registration of the service as a provider. It should not be confused with the process of professional registration with a relevant body such as the Nursing and Midwifery Council or Health and Care Professions Council.
The relevant regulations governing the responsibilities of registered providers, persons and managers can be found in the Care Quality Commission (Registration) Regulations 2009 and the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014.
The Care Quality Commission (CQC) encourages web-based applications for registered managers and providers and requires all statutory notifications to be made electronically. Registered providers and managers should visit the CQC website regularly for updated information on the procedures for registration applications and notifications of changes or incidents.
There are similar requirements for care providers in Scotland and Wales who work to their respective care inspectorates as regulators.
