The Immigration and Asylum Act 1999 and the Carriers’ Liability (Clandestine Entrants and Sale of Transporters) Regulations 2000 (SI 2000 No. 685) impose a duty on operators and drivers of goods vehicles entering the UK to ensure, as far as possible, that no clandestine entrants are concealed in their vehicles.

Penalty

The penalty for each clandestine entrant found in a vehicle is a maximum of £4000, of which up to £2000 can be levied against the operator and up to £2000 against the driver, depending on level of culpability.
