Introduction

This policy sets out this care home’s approach to service users who might lack the mental capacity to make decisions about their care and treatment and who could have their freedom restricted to the point where they are deprived of their liberty.

The service’s policy has been established to comply with the provisions of the Human Rights Act 1998, the Mental Capacity Act 2005 Deprivation of Liberty Safeguards (DoLS), which have applied since April 2009, and the Care Act 2014, and the requirements of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014.

This DoLS policy should be read and used in conjunction with the service’s broader Mental Capacity Act 2005 policy.
