Summary

Schools must set standards of conduct for all staff and specify the types of conduct that will result in disciplinary sanction. They should also devise and implement rules and procedures for dealing with breaches of these standards. The written statement of employment particulars issued to every employee must explain the rules and procedures (including for appeals) or refer the employee to a readily accessible document that explains them.

Disciplinary procedures must be carried out fairly and objectively and any penalty imposed must similarly be fair. Where the penalty is dismissal, the employee has a right not to be unfairly dismissed, subject to the normal qualifying period.
