The German system of health and safety at work has a dual structure. It comprises state health and safety provision and independent accident insurance institutions.

The key legislation is the Occupational Health and Safety Act 1996 as amended in 2019, Arbeitsschutzgesetz (ArbSChG).

Employers' Duties

Employers have a general duty to take necessary occupational safety measures. They must check the effectiveness of the measures and, if necessary, adapt them to changing circumstances. Employers must apply the following general principles in relation to health and safety measures.
