The right to flexible working was embedded in the Employment Rights Act 1996 and strengthened through the Work and Families Act 2006, and the Flexible Working Regulations 2014.

Flexible working includes both flexibility in relation to working hours and the place of work.

All care providers can apply flexible working conditions in different ways in line with the statutory provisions. There is possibly more scope for flexible working in domiciliary care than care homes, where because of shift patterns, the scope is more limited, but even here flexible working arrangements can still be made and are found.
