An employer must provide an employeethe driver or member of staff with a statement of written particulars of the key terms and conditions of employment. This must include the employer’s disciplinary procedure or refer the employee to a separate accessible document that contains the procedure. The disciplinary procedure may or may not be part of the contract of employment.
If a disciplinary issue arises, the employee is entitled to expect the matter to be the subject of reasonable investigation.
Before any disciplinary action is taken, the employee is entitled to be informed of the allegations against him/her, and to be given details of any evidence.
