Prepare for consultation

Employers should:

  • consider starting the statutory process as early as possible when redundancy is contemplated as a possibility

  • consider if any other contractual or statutory consultation obligations require compliance

  • be aware of the duty to consult appointed or elected representatives if it is proposed to dismiss as redundant 20 or more employees within a period of up to 90 days.

  • be aware that if it is proposed to make redundant 100 or more employees, consultation must begin not less than 45 days before the first dismissal is affected. If 20–99 employees are to be dismissed, consultation must begin not less than 30 days before the first dismissal is affected.
