Agency workers are a significant element of the care workforce. It is therefore important to know how to deal with agency workers and agencies. Care services also use agencies to help recruit permanent staff.
Agency workers are protected in the main by two pieces of legislation. The Conduct of Employment Agencies and Employment Businesses Regulations 2003 set out the rules of conduct for employment agencies in relation to job seekers and employers. The Agency Workers Regulations 2010, which came into force on 1 October 2011, provide additional rights and protection to those doing temporary work within organisations working through an agency.
