Employers' Duties

With regard to agency workers, an employer should:

  • understand and clearly specify to the employment agency the type of contractual relationship it wishes to have with the agency worker, eg working on a temporary assignment or with a view to making a permanent appointment

  • identify the reasons for choosing to use an agency worker rather than recruiting a permanent member of staff
