Agency workers (or “temps”) supplied by an employment business are classed as “workers” not employees, they have no right to claim unfair dismissal, minimum notice or a redundancy payment.
They are entitled to certain rights under the Working Time Regulations (ie rest breaks, limits on working time, paid annual leave, National Minimum Wage and anti-discrimination rights under the Equality Act 2010).
The Agency Workers Regulations provide agency workers with the entitlement to the same or no less favourable treatment as comparable, directly recruited once they complete 12 weeks’ qualifying period in the same job.
