The age discrimination provisions in the Equality Act 2010 affect employees’ rights in respect of redundancy selection and redundancy pay.
As a result of the implementation of age discrimination legislation (now contained in the Equality Act 2010), there is no upper age limit for bringing claims of unfair dismissal and for statutory redundancy pay to an employment tribunal. Selection for redundancy based on the age of the employee is unlawful.
