The Equality Act 2010 makes it unlawful for employers to discriminate against employees on the grounds of age, unless the employer can show objective justification for its actions. Denying an employee a particular employment benefit or reducing the level of benefit on the grounds that it costs more for older (or younger) employees is unlawful unless the treatment in question can be shown to be necessary in respect of the needs of the business.
