Adoption leave is a “day one” right. There is no qualifying period. Employees may also be entitled to up to 39 weeks’ statutory adoption pay, but for which there is a qualifying period of 26 weeks of continuous employment, ending with the week in which the couple were notified of the match by the approved adoption agency.

One of a couple having a child through a surrogacy arrangement may also be entitled to take adoption leave and receive statutory adoption pay.

Employees entitled to adoption leave may be able to convert a period of this into a period of shared parental leave and pay, subject to meeting the required eligibility and notifications requirements.
