The Government’s proposals for introducing shared parental leave have been incorporated into the Children and Families Act 2014. It provides that:

  • employed mothers are entitled to 52 weeks of maternity leave as a day one right

  • mothers with partners, where they both meet the qualifying conditions for the shared parental leave system are able to end their maternity leave, after an initial two-week recovery period, and share the untaken balance of maternity leave and pay as shared parental leave and pay

  • parents are able to take shared parental leave concurrently or consecutively

  • shared parental leave must be taken in a minimum of one-week blocks
