The defendant company, AWS, one of the largest water companies in the UK, was responsible for the maintenance of a rising main running under land in Shipdham. The land formed part of Hall Farm which was owned by a local farmer, LF.
The defendant, L, a distributor of pharmaceutical goods, was contacted by the EA in October 2008 as part of routine checks. The EA requested information concerning the amount of packaging which L handled each year and its annual turnover.
The defendant, RC, was a manufacturer of fragrances and food flavourings. As part of its operations it handled both hazardous and non-hazardous glass materials. In accordance with its processes, all hazardous waste materials were to be disposed of by incineration whilst any non-hazardous glass was to be sent for recycling.
The defendant, B, a water and swimming pool chemical treatment company, owned a large unit on an industrial estate in Gloucestershire. B used the site for the storage of chemicals which it used in its business activities.
