In general terms, a zero hours contract can be regarded as a form of on-call working. The workers can be offered hours at short-term notice, as and when the employer needs them. The employer does not guarantee the individual any hours of work and the individual can either accept or reject this work on this occasion. They are only paid for work carried out.

The features of a zero hours contract can be summarised as follows.

  • Employees will usually have the status of a worker but, occasionally, they may be an employee — subject to satisfying the relevant tests for employment status.
