There is no specific legal requirement to include scaffolding on a construction project. However, there are several pieces of legislation relating to health and safety which may influence its use, as follows.
Work at Height Regulations 2005
The Guide to the Regulations states that: “Employers and those in control of any work at height activity must make sure work is properly planned, supervised and carried out by competent people. This includes using the right type of equipment for working at height.” Work at height is defined in the regulations as work in any place (or getting to or from it), where a person could fall a distance liable to cause personal injury.
