A USA supplier has oversupplied some goods; normally this might not be a major issue but these goods are subject to USA Export Administration Regulations (EAR) controls under the Export Control Classification Number (ECCN) 3A001.b.2. We ordered 4 of these parts and have seen a copy of the USA Export License for 4, but the consignment included a quantity of 14. We have isolated the goods in quarantine and contacted the supplier who has asked us just to return the goods at their costs. But I don’t think it’s that easy. As far as I can see, the supplier has “illegally” exported 10 EAR controlled parts. There is a UK Open General Export Licence (OGEL) we could use to return the items but I think we need to do something with the USA controls. Could you advise?
