We have made a sale on FCA Incoterms® Rules on Cash Against Documents (CAD) payment terms; there was an unfortunate incident leading to total loss of goods after delivery at port. The documents had already been sent forward to the buyer for collection. He has refused to collect the documents or file a claim for the damaged goods because he has not insured them. In fact our customer is now simply saying that he chooses to not to pay for the goods and will order from someone else. What is the remedy for the seller?
