The Commercial Rent Arrears Recovery proposals contained in the Tribunals Courts and Enforcement (TCE) Act 2007 set out the government’s plans to abolish distress for rent (the process by which arrears can be recovered by the seizure of the tenant’s goods).
These are considered again in a new consultation process running until 14 May. The consultation sets out the proposals for ‘transforming bailiff action and providing more protection against aggressive bailiffs’.
It aims to ‘simplify and clarify the process, improve the accountability of enforcement agents and address unnecessary or inappropriate enforcement activity’.
